WARNING ABOUT UKRAINE'S EDUCATION LAW!


Certainly, by now, you may have heard news about the new Ukrainian education law, which deprives the national and ethnic minorities in Ukraine, including the Transcarpathian Hungarians, ethnic Romanians, ethnic Poles, ethnic Bulgarians, and ethnic Russians of the opportunity to continue learning their mother tongue after the age of 10 (i.e., effectively prohibiting such tuition in middle school and high school).

In fact, the present law would lead to the abolition of 120 Romanian, 100 Hungarian and 5 Polish language schools, and would negatively affect Bulgarian and Russian minorities as well.

After the recent signing of the Bill by the President of the Ukrainian Parliament, only Ukrainian President Petro Porosenko can now prevent the Bill from gaining the force of the law.

And, there is good reason for Porosenko to VETO the law, as it completely violates Ukraine's Constitution, which (the Constitution) states the following:

Article 53
Citizens who belong to national minorities are guaranteed the right to receive instruction in their native language, or to study their native language in state and communal educational establishments and through national cultural societies in accordance with the law.

Article 10
In Ukraine, the free development, use and protection of Russian, and other languages of national minorities of Ukraine, is guaranteed.

Article 11
The State promotes the consolidation and development of the Ukrainian nation, its historical consciousness, traditions and culture, and also the development of the ethnic, cultural, linguistic and religious identity of all indigenous peoples and national minorities of Ukraine.

Thus, understandably, Ukraine's new law has caused uproar and consternation around Europe. In fact, Andrea Bocskor, a member of European Peoples' Party (pan-European party in the EU) said:

"The law – ignoring the country’s constitution and international commitments – strips ethnic minorities of their right to education in their mother tongue, which is a dramatic step backwards compared to recent (or even Soviet) legislation. Keeping in mind that at least 20 percent of Ukraine’s population is composed of ethnic minorities, it is essential that they respect the language and cultural rights of these communities for the sake of social harmony."

Also, significantly, in response to the new law, the Foreign Ministers of Hungary, Romania, Greece and Bulgaria have sent the Ukrainian Foreign Minister, Pavlo Klimkin, a joint letter communicating "concern" and "deep regret" on the impact of ethnic minorities in Ukraine.

Additionally, the Hungarian Parliament unanimously adopted a cross-party decision condemning the new Ukrainian law, thus giving the Hungarian Government strong legitimacy to take all possible steps to prevent the law from coming into force.

And finally, the civilians and individuals - the national minorities living in Ukraine, are also protesting against the law.

So, we call President Petro Porosenko to veto it!

Join this call, with as many people as possible, together, with all the ethnic minorities living in Ukraine!

This petition will be sent to the United Nations High Commissioner for Human Rights, to the leaders of the European Union, and to the President of Ukraine, asking them to do everything to ensure that this law does not come into force!

Petition to Ukrainian President Petro Poroshenko: Please veto the law on multi-cultural education!

Paragraph 7 of the Education Act, adopted by the Supreme Council of Ukraine on 5 September 2017, is contrary to the Constitution of the country, neglects Ukraine's international commitments, and deprives national and ethnic minorities of the opportunity to study in their mother tongue, accelerating the assimilation processes which fundamentally endangers their survival.

The right to education in one's mother tongue is not only derived from the Constitution of Ukraine, but has been in law for decades, and has existed, for many years, in other states' legal codes (e.g., in Bulgaria, Moldova, Romania, Hungary, etc.).

We, the undersigned, also want to emphasize that Ukraine has committed itself to the provision of national minority education in several bilateral international treaties.

We would kindly remind Mr Porosenko, that in the electoral agreement, announced on the eve of your most recent elections, you agreed that, if chosen as President of Ukraine, you would consent to the positive assessment of language issues, in order to ensure the linguistic rights of the national minorities.

We would therefore ask you, Mr President, to apply your power and political influence on the laws of Ukraine so that this new law not to enter into force. The Education Act violates human rights and fundamental freedoms enshrined in the Ukrainian Constitution at the expense of vulnerable groups of the population, like national minorities.

As such, this petition will also be sent to the United Nations High Commissioner for Human Rights, and to the leaders of the European Union asking them to do everything to prevent this law from coming into force!
