The Supreme Court of Kenya dismissed an appeal by the NGO Co-ordination Board against a High Court order that it registers an NGO seeking to advocate for LGBTQ activism in Kenya. KCPF was involved in the court case representing the pro-life and pro-family voices and all people of goodwill.

The three judges averred that the term sex used in article 27 of the constitution encompasses sexual orientation while we know the term sex to mean either a) sexual intercourse (male and female) or b) the state of being male or female based on reproductive function. They unilaterally and erroneously decided to change the meaning of the term sex thus making it illegal to discriminate on the grounds of sexual orientation. With one stroke of the pen, the judges have turned our national, cultural, and moral values upside down.

The judgment has set us on a slippery slope as the NGO will have the capacity to charge anybody who disagrees with it position or denies its members access to schools, religious institutions, and civil service with discrimination. They will also have the capacity to ask the court to declare the section of the penal code that criminalizes homosexual relationships unconstitutional.

We, the undersigned,

Being citizens of Kenya draw the attention of the house to the fact that the Supreme Court of Kenya dismissed an appeal by the NGO Co-ordination Board against a High Court order that it registers an NGO seeking to advocate for LGBTQ activism in Kenya. Kenya Christian Professionals Forum was involved in the court case representing the pro-life and pro-family voices and all people of goodwill.

The three judges averred that the term sex used in article 27 of the constitution encompasses sexual orientation while we know the term sex to mean either a) sexual intercourse (male and female) or b) the state of being male or female based on reproductive function. They unilaterally and erroneously decided to change the meaning of the term sex thus making it illegal to discriminate on the grounds of sexual orientation. We are petitioning our elected leaders to highlight the displeasure of Kenyans with this decision.

We confirm that this matter is not pending before any court of law or constitutional or legal body.

We pray that parliament enacts laws that determine how freedom of association can be limited, prevent decriminalization of the homosexual act, prevent legalization of same-sex unions, and protect marriage and the natural family.

We also urge the two houses to do the following:-

a.To debate the Court ruling and its implication on constitutional values and cultural values.
b. To discuss possible safeguards to avoid harmful gay ideology spreading in Kenya.
c. To consider amendment of various laws including the Education Act, the Children Act, the Films and Stage Plays Act, the Marriage Act and the Sexual Offences Act to prohibit gay propaganda.
d. To propose a Family Charter plus the establishment of a Family Department in government to work towards greater recognition and protection of the family and family values (art 45, Katiba)
e. To discuss whether it would be appropriate to amend the Constitution (art 24, 27, 36, 45) to restore the intention of Kenyans that LGBT ideology and agenda not get a foothold in Kenya through our laws.
