Madison County judge, Frank Barger, ruled yesterday that an Alabama dad's lawsuit against the abortion facility and the pharmaceutical company in the wrongful death of his aborted baby, Baby Roe, can move forward.

The case is being brought by Personhood Alabama attorneys representing 19-year-old Ryan Magers. Two years ago Ryan's girlfriend informed him that she was going to abort their child, and Ryan tried to convince her not to do it. "I just tried to plead with her and plead with her and just talk to her about it and see what I could do, but in the end, there was nothing I could do to change her mind." Now, he is bringing this case for "the men who actually want to have their baby," Magers told WAAY 31. "I believe every child from conception is a baby and deserves to live."
This is a historic case for several reasons: first, it is the first case where a court has recognized the right of the father to sue on behalf of his prenatal child killed by abortion; secondly, it is being litigated in a state that has the most pro-personhood laws and judges in the country.
Last year, a constitutional amendment was passed by almost 60%, which declared that Alabama would "recognize and support the sanctity of human life" and that the Alabama constitution did not contain a right to abortion.
Alabama is also one of the few states that recognize the child in the womb from conception as a person for purposes of the wrongful death law. Wrongful death laws punish those responsible for the death of a person with monetary damages.
Alabama also has the most pro-life state supreme court in the country. Last year, while still an associate justice, now Chief Justice Tom Parker called on the Supreme Court to overturn Roe v. Wade. “I urge the Supreme Court of the United States to reconsider the Roe exception and to overrule this constitutional aberration,” wrote the Alabama Supreme Court judge, and recommended that the Court “return the power to the states to fully protect the most vulnerable among us.”
We plan to hand Madison County Probate Judge Frank Barger this petition showing him that we stand with Ryan Magers and all men who want to care for and love their pre-born children.
For too long, men have been pushed away by the abortion industry and the law. This has forced women into situations where they feel they are alone. It has also encouraged men to abandon pregnant mothers. This has to stop.
