The Tennessee Infants Protection Act (version SB 1180) advanced to the Senate floor after the Senate Judiciary Committee approved the pro-life measure Wednesday night.

The House of Representatives, Finance Ways & Means Committee will vote on their version of the bill, HB 1189, as soon as Tuesday.

Per our friends at Tennessee Right to Life the Tennessee Infants Protection Act will strengthen the current law enacted in 1973 regarding post-viability abortion, and

• requires viability assessment after beginning of 20th week of pregnancy (LMP) to measure gestational age, weight, or other factors to determine viability;
• defines viability in state law;
• establishes presumption in TN law that an unborn child of at least 24 weeks’ gestation (LMP) is viable.

The Tennessee Infants Protection Act has an influential Republican foe.

Political grandstanding from Attorney General Herbert Slatery III caused delayed for the Senate committee vote as he used his office to voice opposition to the bill. Slatery, plans to fight the passage, saying he’s not sure if a measure that would ban most abortions after 20 weeks would be constitutional.

16 states already have passed the ‘is it constitutional? hurdle’ by implementing prohibitions on abortion at about 20 weeks’ post-fertilization. The Tennessee Infants Protection Act is constitutional under current U.S. Supreme Court doctrine. Slatery is only trying to delegitimize pro-life advocates’ efforts to make important changes to the law.
